Drawing is open to everyone, worldwide, who is 18 years of age or older. The Contest is null and void where prohibited by law. Officers, directors, and employees of Sponsor and judges of the Contest and its affiliates, as well as those individual’s family members and the residents of their household are NOT eligible to enter or to win. Winner and companion must be 18 years or older, hold valid passports and are able to travel internationally.
Promotion Period:
The Promotion begins April 13, 2009 and ends at midnight Central Time on June 30, 2009 (The “Promotion Period”)
How to Enter:
Entries may be made by sending a completed entry form by email to contact@smartgetawayplans.com ; or mailing to Smart Getaway Plans, 6 Cypress Lake Place, The Woodlands, TX 77382; or faxing to 936-273-6861. Entry forms must be complete with all required information (indicated with *) or the entry will be deemed void. Each entry must by authorized by the party listed on the entry form. LIMIT ONE (1) ENTRY PER HOUSEHOLD. Multiple household entries are allowed under the following terms: Once an eligible household has submitted a qualifying entry then for each eligible referral entry the referring household will be allowed one additional entry. Each household may be referred only once and by the first qualified referral received by Smart Getaway Plans. The referring party must be designated on the entry form (in the section REFERRED BY:) at the time of entry submission. The referring party cannot refer themselves, anyone in their household or multiple people in the same household.
Drawing:
On or about 7/1/09, the Sponsor will draw one name from all entries submitted. There will be one winner who will be notified by phone and/or US mail and/or email. BE SURE YOU CORRECTLY ENTER YOUR PHONE NUMBER, VALID EMAIL ADDRESS AND FULL ADDRESS.
Prizes, Approximate Retail Value (“ARV”) & Odds:
One (1) Grand Prize: Smart Getaway Plan’s Six nights Sept. 4-10, 2009 land tour of the French Riviera with accommodations at the Palais de la Mediterranee superior room city or mtn view double occupancy. (Palais de la Mediterranee room upgrade to partial sea view or sea view additional cost will be at winner’s expense and subject to availability). Tour is land only and does NOT include air transportation. See brochure for all inclusions on the tour. (ARV: $4,178). Winner and his/her 18 year or older companion name along with airline travel must be confirmed with SGP, no later than Aug. 1, 2009.
One (1) Second Prize: Smart Getaway Plan’s 50% off six nights for two people Sept. 4-10th 2009 Provence Land Tour with accommodations at the Hotel Ellington for a deluxe room. Winner’s choice of one person one room at $950 per person or two people sharing one room at $750 per person (Hotel Ellington room upgrade is subject to availability and additional cost will be a winner’s expense). Tour is land only and does NOT include air transportation. See brochure for all inclusions on the tour (ARV $1,500 for one room two people or $1,900 for two rooms two people). At Sponsor’s sole discretion, Sponsor reserves the right to end the promotion and award the second prize contest up to 60 days early, or offer more than one second prize or offer winner(s) an upgraded hotel option for an added cost to the winner(s).
No substitution, cash redemption, assignment or transfer of prizes are permitted except at the Sponsor’s sole discretion. If a prize, or any portion thereof, can not be awarded for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. All federal, state and local taxes, and all other costs associated with acceptance or use of the prizes, are the sole responsibility of the winner. Odds of winning any prize depends on the number of entries received. Winners will be notified by email, postal mail &/or telephone. Unclaimed prizes will not be awarded.
General Rules:
All federal, state and local laws apply. Potential winners may be required to sign and return an Affidavit of
Eligibility and Release of Liability and a Publicity Release within seven (7) days of attempted delivery or prize will be forfeited. The return of any prize/prize notifications as undeliverable or failure to return any documents in a timely manner may result in disqualification and an alternate winner may be chosen. By participating, participants agree to release, discharge and hold harmless Promotion Parties from and against any and all liability or damages associated with this Promotion or acceptance, use or misuse of any prize received in this Promotion. Promotion Parties are not responsible for any typographical or other error in the printing of the offer or administration of the Promotion. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winners’ names and the likenesses for purposes of advertising and publicity without further compensation, unless prohibited by law. By participating in this Promotion, participants agree to be bound by the Official Rules and decisions of the independent Judging Agency, which shall be final in all matters relating to the Promotion. Promotion Parties are not responsible for lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered or postage due mail; or for printing, distribution or production errors or for technical, hardware, software, telephone, fax line, or fax machine malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communication caused by the user or by any of the equipment or programming associated with or utilized in this Promotion, or by any human, or other error, which may occur in this Promotion. If, in the Judging Agency’s sole opinion, there is any suspected or actual evidence of tampering with any portion of the Promotion or if technical difficulties compromise the integrity of the Promotion, the Judging agency reserves the right to void suspect entries and/or modify and/or terminate the Promotion, the Judging agency reserves the right to void suspect entries and/or modify and/or terminate the Promotion and/or conduct a random drawing to award the prized using all known eligible non-suspect entries received. Sponsor reserves the right to disqualify any individual who tampers with the Promotion or Website or acts in a disruptive manner. Tax liabilities, if any, are the sole responsibility of the prize winner. This Promotion is offered world wide and is governed by the laws of the State of Texas. By entering, entrants irrevocable consent to the sole and exclusive jurisdiction of the courts of the State of Texas located in the country of Montgomery. For any action, suite or proceeding arising out of or relating to this Promotion.
Confirmed Guests:
In the event that a confirmed guest for the Smart Getaway Plans French Riviera or Provence land tour, is a winner of this contest, any deposits made to Smart Getaway Plans will be returned to the guest/winner of the contest up to the value of the prize won
Waiver:
By participating in this Promotion, participant waives all rights to claim punitive, incidental and consequential damages, attorneys’ fees or any damages other than actual out of picket costs incurred to participate.
